- ELIGIBILITY: Contest open only to residents of the 50 United States, the District of Columbia and Canada who are 18 years of age or older at time of entry. Parental consent to participate in this program is required if Canadian entrant is under the age of majority in his/her province or territory of residence at time of entry. Employees of Procter & Gamble, its affiliates, subsidiaries, advertising, promotion and internet agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state, municipal, provincial and local laws and regulations apply. Void where prohibited by law. Eligibility is expressly conditioned on the acceptance of the Official Rules at time of submission.
- HERE’S HOW IT WORKS: Crest is looking for a new “Catch Phrase” that may be featured in a North-American television commercial, at Sponsor’s discretion. Create an original Catch Phrase of 10-words or fewer that you think is “big enough” to capture the boldness of Crest® Whitening Expressions® – we want to hear your reaction to the experience! Then, create a video of 30 seconds or less of your Catch Phrase and enter your video into the Contest. NOTE: Videos must NOT contain or depict anything in a manner that is inappropriate as outlined in Rule #3. Videos/catch phrases must be in English and/or French. Your video will then be posted at www.youtube.com/crest in the video gallery (subject to the conditions noted in Rule #3). Videos posted in the video gallery will be rated by youtube.com visitors; however, these ratings do not determine the Finalist entries or the prize winners. At the conclusion of the entry period, judges will determine up to 5 Finalist entries which will be posted on YouTube for visitors to vote to determine the Grand Prize winner.
Step #1: Beginning 9:00 AM ET on 9/15/08, visit the Crest “What’s Your Catch Phrase?” page on YouTube at www.youtube.com/crest. If you are a YouTube member, login and upload your video to your YouTube account. If you are not a YouTube member, follow the instructions to sign up for membership (there is no fee to become a member), and then upload your video to your YouTube account.
Step #2: Visit www.youtube.com/crest and follow the on-screen instructions to enter your video into the Crest “What’s Your Catch Phrase?” Contest. To do this, click the “Submit” tab on the Crest “What’s Your Catch Phrase?” Contest page, type in your YouTube username, choose the video you want to submit, read and then check the terms and conditions box and click “Add to Contest”. Once you have selected the video, you will be asked to confirm your entry via a confirmation e-mail that will be sent to the e-mail address that you used to sign up for your YouTube account. You must confirm your entry first before entering the Crest “What’s Your Catch Phrase?” Contest. Upon confirmation, your video will be submitted into the contest.
- You must read and agree to the Official Contest Rules.
ENTRY REQUIREMENTS:
- ALL ENTRIES MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION.
- Submissions must not contain defamatory words/statements (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group); they must not include threats to any person, place, business, or group; they must not disparage persons or organizations associated with the Sponsor; they must not invade privacy or other rights of any person, firm, entity, and they must not in any other way contain material that is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations or the laws or regulations in any state where video is created. The submission cannot contain any unacceptable clothing or adornments, or display any commercial/corporate advertising (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements), except as noted herein, as determined by Sponsor, in its sole discretion. Submissions must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. Submissions may not contain material that is inappropriate, indecent (including but not limited to nudity or pornography), profane, obscene, hateful, tortuous, slanderous or libelous and may not in any way reference persons or their likenesses or organizations without their written permission and without full disclosure to them regarding the entry of the video in the What’s Your Catch Phrase contest. The submission must not contain material that promotes, depicts or suggests any of the following: (a.) Alcohol, illegal drugs, tobacco, firearms or weapons (or the use of any of the foregoing); (b.) Any activities that may be construed as unsafe or dangerous, or promotes any particular political agenda or message; or (c.) Violence of any kind, illegal gambling, child abuse, stalking, sexual assault, fraud, trafficking in obscene or stolen material, drug dealing, theft, conspiracy to commit illegal activity, and threats of violence against a person, place, or organization. The submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Sponsor/judges reserve the right in their sole discretion to disqualify any entry that, in their sole opinion, refers, depicts or in any way reflects negatively upon the Sponsor, the Contest or any other person or entity, or does not comply with these requirements or these Official Rules. Submissions must be suitable for presentation in a public forum, in sole determination of judges and/or Sponsor.
- Not all video submissions will be posted on www.youtube.com/crest. If Sponsor and/or YouTube deems that the video submission does not comply with the Official Rules of the Contest entrant’s video will not appear on www.youtube.com/crest or be eligible to participate in the Contest.
- Submission may include Crest Whitening Expressions brand names and/or trademarks; however, use of its brand names/trademarks is not required. The use of Crest Whitening Expressions brand names and/or trademarks is permitted only for the purpose of entering in this Contest. Entrants shall not submit any material containing the Crest Whitening Expressions brand name and/or trademark to any other third party.
- Any music, lyrics, sounds, props, or any other creative element used in the video must be entrant’s own original creative work and cannot have been previously published.
- The video may contain the entrant only; no other person(s) may appear in the video, in whole or in part. NOTE: it is not necessary for the entrant to appear in the video. If entrant is considered a minor in his/her state/province of residence, entrant must receive permission from his/her parent/legal guardian prior to submission. In addition, entrant must also receive prior written permission from the videographer of their video if the video entry was taped by someone other than the entrant him/herself. IMPORTANT: If entrant is selected as a Potential Finalist, if the video was taped by someone other than the entrant, videographer will be required to sign a publicity release.
- Please do not include any personally identifiable information of yourself or any other person(s) in your video.
- The video can be in color or black and white; the video must be in MPEG, AVI, QUICKTIME, FLV, or WMF format.
- The video should not exceed 30 seconds. If any video entry is longer than 30 seconds in length, it will not be eligible to win a prize.
- The video cannot have been submitted previously in a contest of any kind.
- By submitting entry, 1) entrant certifies that the entry he/she submitted is his/her own original work and he/she holds all rights to the submission, that the submission has not been previously published, has not won a previous prize or award and that he/she has followed the Official Rules of the Contest; 2) if entrant is a minor, entrant certifies he/she has received parental permission to enter this contest; 3) entrant hereby grants Sponsor the right to post submission online for public viewing and 4) entrant acknowledges all material submitted including the catch phrase and the video becomes the sole property of Sponsor.
Entries must be received by 12:00 (noon) ET on 10/17/08. You may enter up to (5) videos from your YouTube account into the contest but each video/catch phrase must be different.
- JUDGING TO DETERMINE THE FINALISTS: All eligible entries received will be preliminary judged by a panel of Sponsor representatives to determine up to (5) Finalists. All judging will be based on the following criteria: Originality & Creativity of Catch Phrase – (40%); Appropriateness of Catch Phrase to the Crest Whitening Expressions brand image – 40% and Clarity of Catch Phrase – 20%. In the event of a tie, tied entries will be broken based on the highest score for Originality & Creativity. Decisions of the judges/Sponsor are final in all matters relating to this Contest.
Potential Finalists will be notified via a message to their YouTube account and will be required to respond and provide their complete name, street address, city, state/province, zip/postal code, email address and phone number within 48 hours of attempted notification. Failure to comply may result in disqualification, at Sponsor’s sole discretion. Potential Finalists will then be required to complete and return required documents as detailed in Rule #7. Limit one Finalist video per person.
- ONLINE VOTING TO DETERMINE THE WINNER: Beginning 9:00 AM ET on 10/24/08 through 5:00 PM ET on 11/7/08, up to (5) Finalist videos will be posted on www.youtube.com/crest. Website visitors will be given the opportunity to view each of the Finalist videos and will be able to indicate a thumbs up or thumbs down vote for each Finalist. Limit one vote per video per day. The Finalist with the highest number of thumbs up votes as determined by YouTube, whose decisions are final, will be will be deemed the Grand Prize Winner. Voting is open to all ages. In the event of a tie, the tie will be broken based on the highest score from the panel judging.
- PRIZES: Up to five (5) prizes, with a total maximum Approximate Retail Value (“ARV”) of $12,064.00 U.S. Dollars will be available as follows: (1) Grand Prize: Winner will receive a check in the amount of $5,000, a trip for winner and a guest to New York City and a sponsor-specified selection of Crest Whitening Expressions product. Plus, the catch phrase from the winner’s video submission may be included in a Crest Whitening Expressions TV spot, at Sponsor’s sole discretion. The trip includes round-trip business class air transportation from major airport nearest winner’s home, two nights hotel accommodations (one room/double occupancy), ground transportation to/from hotel/airport in NYC, a “behind-the-scenes” visit to the production of a Crest Whitening Expressions TV spot and $1,000 spending money. Winner and guest are solely responsible for all other expenses and fees not specifically set forth herein, including but not limited to meals, additional transportation, souvenirs and other incidentals and items of a personal nature. The actual retail value of the prize will depend on winner's point of departure/return. Winner and guest must travel on same itinerary. In the event the TV spot production is cancelled or postponed for any reason, Sponsor will have no obligation to award compensation in lieu thereof but the remainder of the trip will be awarded. If business class air travel is not available, coach class air travel will be booked. The winner may choose to receive $7,000 in lieu of the trip portion of the prize. The Sponsor may also choose to use the winning catch phrase and/or video in future advertising. The broadcast of the TV spot will be at Sponsor’s sole discretion and there is no monetary value associated with broadcast of a TV spot. There will be no compensation of any kind given for Sponsor’s use of winning catch phrase in any TV spot or in future advertising. (ARV: $12,000.00 U.S. Dollars). Up to (4) Finalist Prizes – the remaining Finalists will each receive a selection of sponsor-specified products (ARV: $16.00 U.S. Dollars per prize). Prizes are valued in U.S. Dollars. Prizes consist of only those items specifically listed as part of the prizes. Limit one prize per person.
- GENERAL RULES: Potential Finalists (or parent/legal guardian if potential Finalist is deemed a minor in his/her state/province of residence) will be required to complete an Affidavit certifying that the video submitted is his/her own original work and he/she holds all rights to the video and all elements therein, that the video has not been previously published, has not won a previous prize or award and that he/she has followed the Official Rules of the Contest. Additionally, if potential Finalist is a U.S. resident, Finalist (or parent/legal guardian if potential Finalist is deemed a minor) will be required to complete and return an Affidavit of Eligibility, Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release. To be declared a Finalist, residents of Canada (or parent/legal guardian if potential Finalist is deemed a minor in his/her province of residence) must execute a Declaration and Release Form to release Sponsor and its agencies and representatives from liability with respect to contests and prizes. If the video was taped by someone other than the entrant, the entrant must also submit a completed and signed Publicity Release Permission Form for the videographer. All documents must be completed and returned within (3) days of attempted delivery of same. Noncompliance within this time period or return of any prize/prize notification as undeliverable may result in disqualification and an alternate Finalist may be selected, time permitting. For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. Winners will be notified by mail/phone/email. Traveling companion (or parent/legal guardian if traveling companion is a minor) must also complete and return a Release of Liability within 3 days of winner’s attempted notification. If Grand Prize winner is a minor, winner’s parent/legal guardian will be required to accompany winner on trip and will count as the winner’s guest. If a minor is selected as a traveling companion, winner must be his/her parent/legal guardian. All travelers must possess required travel documents (e.g., valid photo ID, passport, visa etc.) prior to departure. All travelers must agree to depart and return on dates specified by the Sponsor; dates of departure and return are subject to change. No substitution or transfer of prize by winner permitted, except as noted herein. Sponsor reserves the right to substitute prize of equal or greater value. All taxes and/or duties are the sole responsibility of winner. By accepting prize, winner (or parent/legal guardian if winner is a minor) agree to release and hold Sponsor, its respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of use of prize or any travel in connection therewith. Winner (or parent/legal guardian if winner is a minor) assume all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. Acceptance of prize constitutes permission for the Sponsor and its agencies to use winner’s name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. Entrants (or parent/legal guardian if entrant is a minor) agree to release, discharge and hold harmless Sponsor, its advertising, promotion and internet agencies, and their respective directors, officers, employees and assigns, harmless from and against any and all liability and damages. By participating in this promotion, entrants (or parent/legal guardian if entrant is a minor) agree to be bound by the Official Rules, including YouTube terms and conditions, and the judges’ decisions which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of theOfficial Rules,the English version of the Official Rules shall prevail, govern and control. All material submitted including the catch phrase, the video and any other intellectual property rights becomes the sole property of Sponsor and will not be returned. Sponsor/judges reserve the right to reproduce the submissions in full or edit and enhance the submissions at its discretion. Sponsor is authorized to use submissions as it sees fit, including usage in advertising and online without compensation. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. In no event will more than the stated number of prizes be awarded.
NOTICE TO ONLINE ENTRANTS: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Not responsible for faulty, incorrect or mistranscribed phone/e-mail transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. Sponsor assumes no responsibility for undeliverable messages to a user’s YouTube account. Sponsor reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the program; or if a computer virus, bug, or other technical problem corrupts the administration or security of the program as determined by Sponsor/judging agency/administrator, in their sole discretion. In the event of termination, a notice will be posted online and all eligible entries received prior to termination will be judged, per these official rules. If technical malfunctions or suspect voting/irregularities corrupt the voting process, Sponsor reserves the right, in its sole discretion, to award prizes based solely on the Finalists Judging scores or non-suspect votes. In the event a dispute arises regarding specific individual entitled to receive prize, entry made by Internet will be declared made by the "authorized e-mail account holder.” “Authorized e-mail account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide Sponsor with proof that the participant is the authorized e-mail account holder of the e-mail address associated with the account/submission. Any damage made to the Web Site will be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. Proof of submitting entries/votes will not be deemed to be proof of receipt by Sponsor/YouTube. Any use of robotic, automatic, programmed or the like methods of participation/voting will void all such submissions/votes by such methods. Sponsor reserves the right to freeze or close an account or to prohibit the participation/voting of an individual/account holder if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
